TITLE: Whaling Science and International Litigation: Never the Twain Shall Meet? ABSTRACT: Australia's opposition to Japan's scientific whaling program in Antarctica exposes a range of difficulties in testing scientific issues before international courts. Courts need to grapple with the law's treatment of science in its rules and institutions, as well as the science itself. This presentation will examine Australia's case against Japan before the International Court of Justice, highlighting how scientific issues are presented to the Court and how these issues might be resolved. What are the prospects for success from both legal and scientific perspectives?

BIO: Dr. Natalie Klein is Professor and Dean at Macquarie Law School, Macquarie University, Sydney, Australia where she teaches and researches in different areas of international law. Dr. Klein is the author of Dispute Settlement and the UN Convention on the Law of the Sea (Cambridge University Press, 2005) and Maritime Security and the Law of the Sea (Oxford University Press, 2011). Prior to joining Macquarie, Dr. Klein worked in the international litigation and arbitration practice of Debevoise & Plimpton LLP, served as counsel to the Government of Eritrea and was a consultant in the Office of Legal Affairs at the United Nations. Her masters and doctorate were earned at Yale Law School.
