On 17 February 2008, the Assembly of Kosovo formally declared its independence. Following this announcement several states, including Australia, recognised the Republic of Kosovo as an independent state. It has also become a member of a number of international organisations, but not the United Nations. However, the international community remains divided over the recognition of Kosovo as a state. The U.N. General Assembly adopted a resolution on 8 October 2008 referring the matter to the International Court of Justice for an advisory opinion on the question of whether the ‘unilateral declaration of independence’ by the Kosovar Assembly was in accordance with international law.

On 22 July 2010, the International Court of Justice handed down its much anticipated Advisory Opinion on international law of the unilateral declaration of independence in respect of Kosovo.

This case remains highly contentious for a number of reasons, not the least because it highlights the often competing guiding principles of the United Nations, namely, the right to self-determination, and territorial integrity and non-interference. These principles, originally enunciated in the U.N. Charter, were confirmed by the General Assembly in its 1970 Declaration on Friendly Relations and Cooperation.

This roundtable discussion will provide a background to these proceedings and delve into its immediate aftermath including its implications for key international law principles (like self-determination, recognition) and the role of the court itself.
